Terms of Service for Development Tracker#
Effective Date: 2026/11/03
Welcome to Development Tracker. These Terms of Service govern your use of our website at https://devtracker.org, including its publicly accessible development information and the optional Development Tracker Plus membership.
By accessing or using Development Tracker, you agree to these Terms of Service. If you purchase a Plus membership, you also agree to the membership and billing terms described below.
Please read these terms carefully.
1. About Development Tracker#
Development Tracker is an independent platform that collects, organizes, and archives publicly available property development and urban planning information.
Our mission is to make the world’s property development information open and accessible to everyone.
The website provides information about development applications, proposed buildings, planning documents, architectural renderings, project updates, and related materials.
Development Tracker is not affiliated with, endorsed by, or operated on behalf of any municipality or government agency unless expressly stated otherwise.
2. Public Access#
Development Tracker provides access to core development information free of charge.
You do not need to create an account or purchase a subscription to browse public project information, maps, architectural renderings, updates, or archived planning documents.
We may introduce additional optional services or features in the future. Any applicable fees and conditions will be disclosed before purchase.
We reserve the right to modify, improve, reorganize, or discontinue website features as the platform evolves.
3. Accuracy and Reliability of Information#
We make reasonable efforts to collect and present useful, accurate, and up-to-date development information.
However, the information on Development Tracker is compiled from third-party sources, including municipal planning systems and publicly available documents.
Information may be incomplete, outdated, inaccurate, or subject to change.
In particular:
- Development proposals may change significantly during the planning and approval process.
- Project statuses, building heights, storey counts, and other details may be incomplete or incorrect.
- Some information may be extracted automatically from documents using optical character recognition, computer vision, or other automated methods.
- Architectural renderings and drawings illustrate proposals and do not necessarily represent approved or final construction.
- Archived documents may be superseded by newer submissions or decisions.
Development Tracker is intended as an informational and research resource. It is not an official municipal record or a substitute for verification with the relevant authority.
You should independently verify information before relying on it for legal, financial, real estate, construction, planning, or other consequential decisions.
4. Public Documents and Third-Party Content#
Development Tracker collects and preserves copies of publicly available development applications, architectural drawings, reports, renderings, and other planning materials.
These materials may be owned or copyrighted by municipalities, architects, developers, consultants, or other third parties.
The inclusion of material on Development Tracker does not imply that we own its copyright or have authority to grant unrestricted reuse rights.
Access to a document through Development Tracker does not necessarily mean that the document is in the public domain or may be reproduced or distributed without permission.
Where applicable, you are responsible for respecting the intellectual property rights and usage conditions associated with third-party materials.
For further information about document ownership, permitted use, and how rights holders can raise concerns or request the removal or modification of materials, please refer to our Copyright Disclaimer.
5. Permitted Use of the Website#
You may use Development Tracker to browse, discover, and research development information for lawful purposes.
You agree not to:
- Attempt to gain unauthorized access to our systems or infrastructure
- Interfere with the operation, security, or availability of the website
- Introduce malicious software or conduct attacks against the service
- Use automated access methods in a manner that unreasonably disrupts or overloads our infrastructure
- Misrepresent Development Tracker as an official government service or misrepresent our relationship with third parties
These terms do not restrict lawful access to public records from their original sources or remove any rights you may have under applicable law.
Additional terms may apply to any data API, bulk-download service, or other specialized products introduced in the future.
6. Development Tracker Plus#
Development Tracker Plus is an optional paid supporter membership that helps fund the operation, maintenance, improvement, and expansion of Development Tracker.
Purchasing a Plus membership does not provide ownership of the website or any underlying data, documents, or intellectual property.
A. Membership Pricing#
Current membership pricing and details are available on our Development Tracker Plus page.
The applicable price, billing frequency, and total amount payable, including any applicable taxes, will be disclosed before you complete your purchase.
Payments are processed securely through Stripe, our third-party payment processor.
B. Automatic Renewal#
Plus is an automatically renewing annual subscription.
Unless you cancel automatic renewal before the next billing date, your membership will renew for another annual term and your payment method will be charged the applicable renewal price.
You authorize these recurring charges when you complete your purchase.
We will provide notice of material price changes before they take effect, as required by applicable law. You may cancel future renewal if you do not wish to continue at a revised price.
C. Cancellation#
You may cancel automatic renewal at any time through our online membership management portal or by contacting [email protected].
Cancellation ordinarily takes effect at the end of your current paid membership period.
If you cancel automatic renewal, you will not be charged for subsequent membership periods unless you choose to subscribe again.
Cancellation by itself does not automatically issue a refund for a payment already made.
D. 14-Day Refund Guarantee#
We offer a 14-day full-refund guarantee for Plus membership payments.
You may request a full refund within 14 days of:
- Your initial membership purchase; or
- Any subsequent annual renewal payment.
To request a refund, email [email protected] within 14 days of the applicable payment.
If a full refund is issued, the corresponding membership will end and any future automatic renewal will be cancelled.
After the 14-day period, membership payments are generally non-refundable unless required by applicable law or otherwise approved by Development Tracker.
This voluntary refund policy does not limit any cancellation, refund, or other consumer rights provided by applicable law.
E. Current and Future Membership Benefits#
At launch, Plus is an optional way to financially support Development Tracker. No exclusive features or content are currently included.
We may explore additional Plus benefits in the future, but we do not guarantee the availability, timing, or inclusion of any particular future feature.
Our core public development information will remain accessible without requiring a Plus membership under our current service model.
F. Membership Communications#
By subscribing, you agree to receive transactional communications necessary to administer your membership, such as payment confirmations, invoices, renewal notices, cancellation confirmations, and billing-related messages.
These communications are separate from optional promotional marketing.
7. Payment Processing#
Payments for Development Tracker Plus are processed by Stripe.
When making a payment, you may also be subject to Stripe’s applicable payment and service terms.
Development Tracker does not directly collect or store full payment card numbers.
Please review our Privacy Policy for information about how billing and membership data is handled.
8. Availability and Changes to the Service#
We aim to maintain reliable access to Development Tracker, but we cannot guarantee uninterrupted availability.
The website may occasionally be unavailable due to maintenance, technical issues, infrastructure failures, or circumstances outside our control.
We may change how information is collected, organized, displayed, or archived. We may also remove or correct information when necessary.
We do not guarantee that every development application or document will be available, that records will be retained permanently, or that coverage will remain identical across cities.
Changes to paid membership terms will be communicated as required by applicable law.
9. Disclaimer of Warranties#
Development Tracker and its content are provided on an “as is” and “as available” basis.
To the extent permitted by applicable law, we make no warranties or representations regarding the completeness, accuracy, timeliness, reliability, or availability of website content.
We do not guarantee that the website will be free from errors, interruptions, or security vulnerabilities.
Nothing in these terms excludes warranties, guarantees, or rights that cannot lawfully be excluded.
10. Limitation of Liability#
To the extent permitted by applicable law, Development Tracker is not responsible for losses arising from reliance on inaccurate or incomplete development information, temporary website unavailability, or other circumstances outside our reasonable control.
This includes decisions made using project estimates, automated data extraction, archived documents, or development proposals that may subsequently change.
Nothing in these terms limits or excludes liability where doing so would be prohibited by applicable law, including applicable consumer protection requirements.
11. Third-Party Websites and Services#
Development Tracker may link to external websites, municipal portals, and other third-party services.
We do not control these services and are not responsible for their content, availability, accuracy, or terms.
Your use of external websites and services is subject to their respective policies and conditions.
12. Privacy#
Your use of Development Tracker is also subject to our Privacy Policy.
The Privacy Policy describes how we collect, use, disclose, retain, and protect personal information, including information associated with Plus memberships.
13. Changes to These Terms#
We may update these Terms of Service to reflect changes to Development Tracker, our membership offerings, or applicable legal requirements.
Updated terms will be published on this page with a revised effective date.
Where required, we will provide additional notice or obtain consent before material changes take effect.
Changes will not retroactively alter completed transactions or remove rights already accrued under applicable law.
14. Governing Law#
These Terms of Service are governed by the laws of Ontario and the applicable federal laws of Canada, subject to any mandatory consumer protection laws or other rights that apply in your jurisdiction.
